The Manitoba Court of Appeal allowed the appeal, set aside the Anton Piller Order and ordered the return of the seized property to the defendants. The Manitoba Court of Queen's Bench refused to rescind the order. The defendants sought to have the order rescinded. The plaintiffs obtained and executed an ex parte Anton Piller Order to enter upon the defendants' premises and seize computer programs.
